Terms and Conditions of Use
All prices listed on www.defconpaintballgear.com are in Canadian Dollars (CDN $$)
By browsing, shopping, or purchasing from this website (www.defconpaintballgear.com) you agree to the following terms and conditions of use:
Returns Policy
You may return new, unopened items within 14 days of the original receipt date for a full refund. We will also pay the return shipping costs if the return is a result of an error (you received an incorrect or defective item, etc.). All products must be unused, in new condition, and accompanied by all the original manufacturer's packaging, manual(s), blank warranty cards, and miscellaneous part and accessories. Items in sealed clam-shells must be unopened.
Items are subject to an inspection and all decisions made by Defcon Paintball Gear as to the condition of items, and their eligibility for return or exchange, are final.
Defcon Paintball Gear makes no guarantee, explicit or implied, that paintballs shipped to you will arrive unbroken.
No returns will be accepted on closeout or final sale items.
No returns or exchanges will be accepted on items that are used, damaged, not in original condition, missing any parts or materials, or with missing or damaged packaging. An item will be deemed used if there have been any attempts to install, modify, shoot, test fire, wear or wash.
Items returned that are not eligible for return will be returned at the customer's expense.
Unfortunately all shipping charges are non-refundable. If any order has received free shipping, the shipping costs will be deducted before the store credit or refund is issued.
You should expect to receive your refund within four weeks of giving your package to the return shipper, however, in many cases you will receive a refund more quickly. This time period includes the transit time for us to receive your return from the shipper (5 to 10 business days), the time it takes us to process your return once we receive it (3 to 5 business days), and the time it takes your bank to process our refund request (5 to 10 business days).
If you need to return an item, simply login to your account, view the order using the "Complete Orders" link under the My Account menu and click the Return Item(s) button. We'll notify you via e-mail of your refund once we've received and processed the returned item.
Shipping
We can ship to virtually any address in the world. Note that there are restrictions on some products, and some products cannot be shipped to international destinations.
When you place an order, we will estimate shipping and delivery dates for you based on the availability of your items and the shipping options you choose. Depending on the shipping provider you choose, shipping date estimates may appear on the shipping quotes page.
Please also note that the shipping rates for many items we sell are weight-based. The weight of any such item can be found on its detail page. To reflect the policies of the shipping companies we use, all weights will be rounded up to the next full pound.
Credit Cards
We accept the following credit card for payment: Visa, MasterCard, and Discover. There is no surcharge or extra fees for using your credit card to make purchases. We will only ship to the cardholder's address, please provide your exact billing address and telephone number (i.e. the address and phone number your credit card bank has on file for you). Incorrect information will cause a delay in processing your order and may result in your order being cancelled. Your credit card will be billed immediately upon acceptance of your order.
Free Shipping
Free shipping only applies to destinations in Canada that are accessible by ground routes. Areas that are only accessible only by air are exempt from this offer. If your area is serviced only by air, then our free shipping offer does not apply and we will contact you at the email address or phone number you provided regarding the costs of your shipment.
Free Shipping applies to orders of Paintball products $150 or more and Airsoft products $300.00 or more. Free shipping for Paintball & Airsoft orders is subject to the location restrictions below. Sales taxes is excluded from the calculation of the free shipping threshold.
Free Shipping does not apply during sales or specials offers unless specified.
Postal codes starting with the following are possibly only serviced by air: A0K, G0G, J0M, P0L, P0V, R0B, S0J, T0H, T0P, V0J, V0N, V0P, V0R, X0A, X0B, X0C, X0E, Y0B. Free shipping is not available for Newfoundland/Labrador, Nunavut, Northwest Territories, and Yukon Territories. Some other regions may apply due to shipping courier restrictions.

Price Matching
If you happen to find a lower advertised price online, Defcon Paintball Gear will match the price as long as the following criteria is met:
- The lower advertised price is on another Canadian paintball website
- The store/company selling the product must have a brick and mortar store in Canada and must be selling the goods in Canadian dollars
- The company selling the goods must have the product in stock
- The product being sold must be identical to the one we are selling on our website
- Before placing your order on Defconpaintballgear.com, you must send us an email request to price match. Please include a link to the competitor’s webpage for faster processing
- The product's price must not be lower due to an advertising error, misprint, or special sales price.
- Special sale prices include: Black Friday, Cyber Monday, Boxing Day, special educational prices, restricted offers, mail order offers, rebates, coupons, premiums, free or bonus offers, original equipment manufacturer (OEM) prices, close-outs, liquidations, clearances, and financing offers.
- Our lowest price guarantee does not apply to Black Friday, Cyber Monday, or Boxing Day/Week sale prices. We will NOT adjust prices, provide a credit or refund for the difference.
Please note: Defconpaintballgear.com refuses the right to match prices, regardless if the above criteria is met. We will inform you of this at the time of your request.

Pricing Errors and Typographical Errors
In the event a product is listed at an incorrect price or with incorrect information due to typographical error or an error in pricing or product information, Defcon Paintball shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Defcon Paintball Inc. shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Defcon Paintball Inc shall issue a credit to your credit card account in the amount of the charge.
Substitution of Items and Back Orders
We reserve the right to substitute paintball color if the the ordered color is unavailable. We may, out our discretion, substitute like-kind-items where a brand is considered a commodity item. In the event of a back order situation, we will use our discretion to process an order and release the order in a timely fashion. This may include an order being shipped incomplete or a delay in processing if we are shipping it complete. We make an effort to contact customers in the event of a backorder situation.
Disclaimer and Limitation of Liability of Products Sold
Except as expressly stated herein, Defcon Paintball Inc. makes no representations or warranties, either express or implied, of any kind with respect to products sold on the Defcon Paintball Inc sites. Except as expressly stated herein, Defcon Paintball Inc. expressly disclaims all warranties, express or implied, of any kind with respect to products sold on this site, including but not limited to, merchantability and fitness for a particular purpose. You agree that the sole and exclusive maximum liability to Central Ohio Paintball, Inc. arising from any product sold on the Central Ohio Paintball sites shall be the price of the product ordered. Local, Provincial, Federal, Laws on Products
It is the responsibility of the buyer, not the seller, to ascertain and obey all applicable local, provincial, federal, and international laws in regard to the possession, use, and sale of any item purchased from Defcon Paintball Inc. By placing an order, the buyer represents that the products ordered will be used only in a lawful manner and that he/she is of legal age.

Contact Policy
While processing your order, we may need to contact you by phone or e-mail. You agree to provide us with good contact information to ease this process. Also, when you set up your account, we collected your e-mail address. We may contact you with product information, special sales and other relevant news and information from time to time by e-mail. For your convenience, our e-mail list server will allow you to opt out of this list at any time. Your personal information is never sold or shared with other parties.
Order Acceptance Policy
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Defcon Paintball Inc. reserves the right at any time after receipt of your order to accept or decline your order for any reason. All orders must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance and customer service department. We may require additional verifications or information before accepting any order.
Sales Taxes
Defcon Paintball Inc. shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within Ontario, Canada. Each customer shall be solely responsible for all sales taxes, or other taxes, on orders shipped to any other state and/or province.
Jurisdiction and Venue
You agree that the laws of the province Ontario shall govern any legal action brought against DEFCON PAINTBALL INC. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made on the Defcon Paintball Inc. sites shall be an appropriate federal or provincial court.
